In the absence of statute (prior to enactment of Chapter 148, Laws of 1931) making it incumbent upon a board of county high school trustees to let a contract for the erection of a high school building only on competitive bids, it was not required to do so, section 1016, Revised Codes of 1921, relating to the duties of boards of trustees of school districts in that behalf not applying to trustees of county high schools. Statutes and Statutory Construction — Change of Effect of Statute by Codification of Laws — Legislative Intent. 2. Legislative intent to change the effect of a statute by codification of the laws on the subject must appear clearly before the courts will adjudge a change. County High Schools — Erection of School Building — Changes and Alterations — Board of Trustees not Required to Ask for Bids Under Applicable Statute. 3. Where, at the time a board of county high school trustees let a contract for the construction of a high school building, the law relating to county high schools did not require competitive bids (although such bids were called for), the board was not obliged thereafter to advertise for bids for making certain changes and alterations in the contract resulting in a reduction of the contract price.
